General

These Terms of Service govern, together with the Privacy Policy, your use of the Sleep Cycle alarm clock mobile application (the ”Application”) and related services provided by Sleep Cycle AB, 556614-7368, Kungsgatan 46, 411 15 Gothenburg, [email protected] (”Us”, ”We”).

The Application tracks and analyzes your sleep, waking you up at the most perfect time, feeling rested! To read more about how the Application works, please see https://www.sleepcycle.com/how-sleep-cycle-works/. 

You confirm and affirm that you have read, understood and agree to these Terms of Service. If you do not agree to these Terms of Service, do not use the Application.

Intellectual Property Rights

The Application and all related trademarks, logos, software and other intellectual property rights are and shall remain our exclusive property. Your right to use the Application and its content is personal, non-exclusive, non-sublicenseable and non-transferable. Any copying, republication or redistribution of the Application or any of its content is strictly prohibited.

Disclaimer of Warranty

The Application and all of its content is provided on an ”As Is” and ”As available” basis and We do not provide any assurances of the availability or usability by you of the Application.

Limitation of Liability

We shall not be liable for any errors in any content or for any actions taken in reliance thereon. Furthermore, we shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data or compatibility conflicts).

Price and Payment Options

Applicable price for your subscription is set out in the ordering process. We show prices including VAT. Changes in price will be communicated to you with 30 days’ notice and you are able to cancel your subscription at any time.

Payment options are card payment or PayPal. 

Payments are processed by FastSpring, their terms and conditions are set out in the ordering process. Processing charges can be added to orders. The exact sum depends on which payment method is used and indicated at the checkout before the purchase is completed.

Sleep Secure Subscription and Cancellation

The subscription is entered into for an indefinite term and You may at any time terminate your subscription, in which case your subscription will still be valid for the subscription time you have already paid for. 

Did you purchase premium in-app?

Our auto renewable In-app purchase subscriptions can only be cancelled using the App Store or Google Play cancelation services. If you would like to contact Apple, please click here. 

Did you purchase premium through our web?

Our auto renewable web purchase subscriptions can only be cancelled using either Fastspring cancelation services or our ‘My account’ page. If you would like to contact us, please click here.  Subscription fees can be found in the mobile application Sleep Cycle alarm clock or your ‘my account’ page if you’re a web subscriber. We reserve the right to change the subscription fees from time to time. 

Right of Withdrawal

You have 14 days’ statutory right to withdraw from the purchase of the subscription. The right to withdrawal period is counted from the day you may use the Application.

If you exercise your right to withdrawal you shall inform Us by e-mail or use the Sleep Cycle Withdrawal Form and send the form to Us at the address at the top, or email us at [email protected].

If you exercise your withdrawal right, We will reimburse you for the payments made (if any). Any refunds will go directly back to your bank card. If you have paid via another method, the money is transferred to your bank account. Refunds will be processed without further undue but at the latest within 14 days from your withdrawal.

Miscellaneous

We reserve the right to, from time to time, in our sole discretion amend these Terms of Service. It is your responsibility to review these Terms of Service from time to time to understand the extent of changes. Your continued use of the Application constitutes your agreement to the amended and updated Terms of Service.
